آليات حماية حقوق الإنسان في المنظومة القانونية الجزائرية

Abstract

تتعامل هذه الدراسة مع مجموعة من المفاهيم مثل: الضمانات، الآليات والمنظومتين (الوطنية و الدولية). إن مفهوم الضمانات يوفر أساسا لتوظيف الآليات بنوعيها (الإجرائية والمؤسسية). هذه الآليات تشكل منظومة شبكية ضمن المستويين الداخلي والدولي. بدون هذه الآليات لا يمكن التحدث عن مسألة حماية وترقية حقوق الإنسان بما فيها حق المشاركة السياسية والحق في التجمع والحق في الترشح وكذا الحق في التصويت. إن التركيز على الآليات كان يهدف إلى معرفة درجة الحماية المقررة لحقوق الإنسان، إذ يتم الانتقال من مرحلة المبادئ فقط والمعروفة بالضمانات المنصوص عليها دستوريا وقانونيا إلى مرحلة أعلى (مرحلة الحماية والترقية) التي تتولى تجسيدها المنظومة الشبكية الآلية في إطار الاعتماد المتبادل. فالدراسة، اذا، انطلقت من إشكالية أساسية تقوم على عرض الآليات المختلفة ذات الفعالية للحماية والترقية في الجزائر في معناه النوعي- القانوني وليس الكمي. أخيرا، فإن الدراسة تهدف إلى التمييز بين الآليات المختلفة في جوانبها الإجرائية والمؤسسية (المؤسساتية) الذي نادرا ما تم توظيفه بدقة في كثير من الدراسات السابقة. يلاحظ أن بعض الآليات المؤسسية تستخدم في أن واحد الآليات الإجرائية مثل اللجنة الوطنية الاستشارية لترقية وحماية حقوق الإنسان التي تقوم على نظام التقارير الدورية وتتلقى الشكاوى وتعمل توصيات إلى رئيس الجمهورية وكل هذا يتلخص في الجدول الرئيسي الذي قامت الباحثة بإعداده تحت عنوان: الآليات الوطنية والدولية لحقوق الإنسان مع التركيز على الوطنية منها. This study deals with a set of concepts such as: guarantees, mechanisms and systems (National and International). The concept of safeguards offers a back ground for using of both types of mechanisms (procedural and institutional). These mechanisms constitute a network system within the domestic and international. Without these mechanisms, we can not to talk about promotion and protection of Human Rights including, the right to political participation, the right of assembly, the right to vote and the right to run. The focus on mechanisms aimed to know the degree of protection, which is assigned to human rights, By both moving from the level of principles(known as a level of guarantees provided in the constitution and laws) to a higher level (The level of protection and promotion) holds the embodiment of the system network mechanism within the framework of interdependence between national and international levels . This study, thus, starts from a thesis which focuses on presenting the diffrent mechanisms in their qualitative- legal meanings and not a quanitative one. It also, distinguishes between the diffrent mechanisms in their procedural and institutional aspects which are, rarely ,used accurately in the previous writings. It should be noted that some institutional mechanisms use procedural mechanisms in their work as in the case of National Consultative Commission for Promotion and Protection of Human Rights (CNCPPDH)which, recieves reports, and complaints and make recommendations to the Algerian president .and all of this is sumerrised in the main table composed by the researcher under the title : « National and International mechanisms of Human Rights »,with a focus on national onces.
