السياسة الجنائية في مكافحة الهجرة غير الشرعية

Abstract

تعد جريمة الهجرة غير الشرعية من ضمن الجرائم المتصدرة لرزنامة اهتمامات دول العالم، لما نجم عنها من تحديات اثرت سلبا على امن واستقرار الدول المستقبلة بالدرجة الاولى. هذه الجريمة المستحدثة التي ساهمت في خلق العديد من الجرائم اهمها تهريب المهاجرين، و جرائم الاتجار بالبشر و الاخطر من ذلك الجريمة الارهابية، فرغم الجهود الدولية و الوطنية في التصدي لهذه الجريمة غير ان هذه الاخيرة في تزايد و تطور مستمر نتيجة لتكاثف عدة اسباب اهمها الاوضاع الاقتصادية و الامنية التي تعاني منها جل شعوب الدول المصدرة، الامر الذي يحتاج الى اعادة النظر في جل هذه السياسات المنتهجة و بخطة جديدةتتماشى و الاوضاع الحالية تعتمد على دراسة متانية لاسباب هذه الجريمة، لان اساس السياسة الجنائية الناجحة معرفة الاسباب الحقيقية وراء كل جريمة بغية التوصل الى سبل الوقاية منها او الى حلول ناجعة في التصدي لها. le crime d'immigration illégale figure parmi les crimes les plus graves dans le monde en raison des difficultés qui ont affecté la sécurité et la stabilité des pays accueillants, ce qui a engendré un certain nombre de crimes dont le plus important est le crime tarfic illicite des migrants. Malgré les efforts internationaux et nationaux pour faire face à ce crime, mais celui-ci continue de croître et de se développer continuellement en raison de l'intensification de plusieurs raisons, des conditions économiques et de sécurité les plus importantes rencontrées par la plupart des pays exportateurs. Ce qui fait connaître et planifier une nouvelle ligne et la situation actuelle dépend d'une étude attentive des causes de ce crime, parce que la base de la politique pénale réussie de connaître les vraies raisons derrière chaque crime afin de trouver des moyens de les prévenir et à des solutions efficaces pour y faire face. The crime of illegal immigration is among the leading crimes of the world's concerns because of the challenges that have negatively affected the security and stability of the receiving countries. This crime has created many crimes, the most important of which is the crime of smuggling of migrants, Despite the international and national efforts to deal with this crime, but the latter is growing and developing continuously due to the intensification of several reasons, most important economic and security conditions experienced by most peoples exporting countries, which needs to be reviewed most of this made known and plan a new line and the current situation depends on a careful study of the causes of this crime, because the basis of successful criminal policy to know the real reasons behind every crime in order to find ways to prevent them and to effective solutions in addressing them.
