علم تخريج الفروع على الفروع وأثره في فتاوى الشيخ الطاهر بن عاشور

Abstract

ملخص المقال: يُعتبرُ تخريج الفروع على الفروع من أهمّ المسالك التي تُتَّبع في بيان أحكام الوقائع المستجدة واللامتناهية عبر الأزمنة والعصور، فَعَّله أتباع الأئمة جيلا بعد جيل إلى زمننا المعاصر، فجاء هذا البحث ليُقدم أنموذجا من المعاصرين الذين سلكوا هذا المسلك في فتاويهم، ويكشف جانبا مهمّا من جوانب الشخصية العلمية لعَلَم من أعلام المقاصد والتفسير؛ حيث بيَّنت هذه الدراسة أهمية هذا المسلك الاجتهادي وما له من أثر في فتاوى الشيخ العلاّمة محمد الطاهر بن عاشور، الأمر الذي يدلّ على تضلُّع الشيخ ورسوخ قدمه في مذهب الإمام مالك وإحاطته بأصوله وفروعه، وكذا قدرته الفائقة على استنباط أحكام ما جدَّ من وقائع في عصره، إلحاقا لها بالمناسب ممَّا نُصَّ على أحكامه في مذهب إمامه. كما بيَّنت الدراسة أنَّ المخرِّج يحتل المرتبة الثالثة ضمن طبقات المجتهدين، ويجمع بين الاجتهاد والتقليد. Abstract : The extraction branches to branches is considered as one of the most important courses that is followed in interpreting the endless and emerging events throughout the times and ages, it was done by the followers of the imams a generation after a generation till our contemporary period; this research came to introduce an example of coevals who followed that course in their legal opinions, and it shows an important aspect of the scientific personality for one of the leaders of interpretation and reasoning sciences; this study shows the importance of this course and its impact on the legal opinions of Sheikh Ben Achour, which indicates his knowledge about the doctrine of imam Malek with its assets and branches.
