حجية التوقيع على القرار الإداري الإلكتروني

Abstract

تناولت الدراسة موضوعا مهما من موضوعات القانون الإداري المستحدثة في ظل التطور الذي تشهده تكنولوجيا المعلومات والتوجه المتسارع صوب عصرنة العمل الإداري وتقديم الخدمات العمومية إلكترونيا. فقد أصبح التعامل بالقرار الإداري الإلكتروني أمرا ملحا خاصة في ظل جائحة كورونا لتلبية الحاجات العامة للمواطنين والمحافظة على استمرار سير المرافق العامة بانتظام واطراد، إلا أنه في العالم الإلكتروني، يجب على الشخص الطبيعي أو حتى الشخص الاعتباري، أن يعرّف عن نفسه في أعين الفاعلين الآخرين من خلال الإعلان عن هويته، إذ أن أي معاملة تتم بواسطة وسائل إلكترونية تثير الشكوك بين الناس وبناءا على ذلك يشترط حتى يتمتع القرار الإداري الإلكتروني بالحجية ذاتها الممنوحة للقرار الإداري التقليدي في مجال اثباته ونفاذه أن يوقع بواسطة التوقيع الإلكتروني .
