أثر التوقيف للنظر على الحرية الفردية أثناء مرحلة التحقيق التمهيدي

Abstract

يعتبر إجراء توقيف للنظر من أخطر الإجراءات التي يمكن اتخاذها أثناء مرحلة التحقيق التمهيدي، إذ بمقتضاه يتم سلب حرية المشتبه فيه لفترة من الزمن، وهو الأمر الذي يتعارض مع كونه برئ إلى غاية إثبات عكس ذلك بموجب حكم قضائي نهائي. إلا أنه وبالرغم من مساس هذا الإجراء بالحرية الفردية للمشتبه فيه، إلا أن المشرع قد أجاز اللجوء إليه كوسيلة إجرائية يمكن لها أن تساعد ضباط الشرطة القضائية للوصول إلى الحقيقة، والمحافظة على المصلحة العامة، وتحقيق عدالة جنائية فعالة، سواء كان الأمر متعلق بالتحريات في الحالات العادية، أو حالات التلبس بالجريمة، وعليه وبالنظر إلى خطورته، جعل المشرع من ممارسته مقيدة، وذلك من خلال وضعه لجملة من الضمانات والضوابط تكفل الحماية الحرية الفردية للمشتبه فيه من التعسف. Making an arrest against a suspect is considered One of the most dangerous measures that can be taken during the preliminary investigation stage, in which the suspect is deprived of liberty for a period of time, and this matter is opposes the fact that he is an innosent person until it proves otherwise. However, despite this violation of the suspect's individual liberty, the legislator has authorized resorting to it as a procedural means that can help the judicial police officers to reach the truth, maintain the public interest, and achieve effective criminal justice, whether it is related to investigations. In ordinary cases, or cases of flagrante delicto, and in view of its seriousness, the legislator made his practice restricted, by setting a set of guarantees and controls to protect the individual freedom of the suspect from arbitrariness.
