إدارة الولاية بين اللامركزية وعدم التركيز على ضوء القانون 12/07 الخاص بالولاية بالجزائر

Abstract

الدراسة تتناول موضوع إدارة الولاية بين اللامركزية وعدم التركيز على ضوء القانون الخاص بالولاية، وتهدف إلى إبراز مظاهر التنظيم الاداري في الجزائر الذي يجمع بين مركزية اختصت بالشؤون الوطنية والقطاعية الممركزة، وبين لامركزية ادارية في بعض اختصاصات الجماعات الإقليمية على المستوى المحلي، ومحاولة تقديم قراءة مقارنة حول صلاحيات ومهام الوالي كممثل للدولة أين يتمتع بصلاحيات تنفيذية واسعة تمكنه من التحكم في تنشيط ومراقبة مصالح الدولة غير الممركزة، مع تحديد بعض صور الرقابة الوصائية على المجلس الشعبي الولائي أين يصدر الوالي قرارات من أجل تنفيذ مداولاته. في مقابل صلاحيات المجلس الشعبي الولائي التي تبقى غير ملزمة وجد محصورة أين يتحول في بعض صلاحياته الى قوة اقتراح فقط يساعد مؤسسات الدولة المركزية في مهمة تنمية الولاية وتسييرها. تقدم الدراسة تصورات حول إمكانية تجاوز كل صور عدم التكامل في الصلاحيات التي تم تسجيلها من خلال إصلاح ومراجعة التنظيم القانوني للولاية بجعله أكثر انسجاما مع الطابع اللامركزي سواء في النص الدستوري أو القانون الخاص بالولاية بالشكل الذي يسمح بتوسيع مجالات تدخل المجلس الشعبي الولائي وإعطائه المزيد من الصلاحيات، ودورا أكبر للمنتخبين المحليين في إدارة شؤون الولاية وتنميتها. This study tries to examine the issue of The Administration Of The Wilaya in Algeria Between Decentralization And Deconcentration In The Law 7/12 of Wilaya, and aims to clarify the forms of administrative organization in Algeria which combines centralization and administrative decentralization at local level in the functions and roles of local authorities. This study tries to comparison between The prerogatives and tasks of the Wali as a representative of the State, that they have important executive powers, with localization of some forms of repression on The APW. In addition to the tasks of the APW, which are not compulsory and limited, some of its prerogatives and tasks are suggestions, and also help the central institutions of the State in the task of developing and managing the State. The study gives perceptions of the possibility of reforming and revising the legal organization of the Wilaya by making it more in line with the decentralization, whether in the legal texts or Wilaya law. In a way that widens the areas of interference of the APW and gives it more greater roles in the management and development of Wilaya affairs.
