Abstract

يكتسي موضوع إلحاق نسب ولد الزنا بالبصمة الوراثية أهمية بالغة على المستويين الفقهي والقانوني نتيجة ارتباطه بالواقع الحي، في ظل تنامي فاحشة الزنا وتزايد نسبة اللقطاء المهددين بمستقبل مجهول. ويعتبر اكتشاف البصمة الوراثية على يد العالم الإنجليزي ألك جيفري عام 1984 وُثوب نوعي يفتح المجال واسعا أمام هذه الفئة للوصول إلى حقيقتها الطبيعية لما تتميز به هذه الوسيلة من قدرة في تحديد الروابط الوراثية، وبالتالي فموضوع الدراسة من أهم مواضيع الساعة الرامية إلى ترشيد استخدام تقنية البصمة الوراثية بما يتلاءم والكشف عن الأبوة البيولوجية بين نتيجة الزنا وماء الزاني. ويأتي هذا البحث للإجابة على الجدل والاختلاف الفقهي والقانوني المتعلق بمدى إمكانية إلحاق نسب الولد غير الشرعي بالبصمة الوراثية فقها وقانونا؟ وبيان منزلتها بين الأدلة الشرعية والقانونية لإثبات النسب، وتوضيح موقف كل من الفقه الإسلامي والقانون الوضعي من توظيف هذا الدليل العلمي لإلحاق نسب ولد الزنا.
