الحماية القانونية للعمليات المصرفية من خلال تشريعات بنك الجزائر لأنظمة الرقابة الداخلية في البنوك في ظل النظام (11-08)

Abstract

إن الرقابة الداخلية في البنوك تعتبر جزءا أساسيا من الرقابة المصرفية الشاملة ولأهميتها فقد أوليت بالاهتمام الكبير من الإدارات المسؤولة عن البنوك، كونها تمثل خط الدفاع الأول في منع وصد وتحجيم المخاطر والأخطاء التي يمكن أن تتعرض لها البنوك في أعمالها اليومية، وفي هذا المجال تم وضع إطار تشريعي وتنظيمي تبنى هيئات وأجهزة مصرفية تحاول توفير المناخ الملائم للسلامة المصرفية. لذلك شرع بنك الجزائر بإجراء تعديلات هيكلية وتنظيمية على القطاع المصرفي وتبني تشريعات مصرفية جديدة بهدف تقوية الأساليب الإشرافية والرقابية وتحقيق سلامة القطاع، حيث بينت الممارسة اليومية للعمل المصرفي أن هناك العديد من المخالفات أو الأخطاء الناتجة عن قصور نظام الرقابة الداخلية، وخلفت هذه الأخطاء آثارا على العمل المصرفي مما أوجب على بنك الجزائر إصدار أنظمة وتعليمات من شأنها تعزيز الثقة في البيئة الداخلية للبنك. The Internal Control in Banks is an essential part of the comprehensive Banking Supervision, and it has been given great interest of the departments responsible for the Banks, as they represent the first line of defense in preventing the repulse to minimize Risks and Errors that can be exposed by Banks in its daily work, and in this regard has been adopted a Legislative and Regulatory Framework, Entities, and Banking Systems are trying to provide appropriate climate for Banking safety. So began the Bank of Algeria to make Structural and Regulatory changes to the Banking sector and the adoption of new Banking Legislation in order to strengthen the Supervisory and Regulatory methods and achieving safety sector, where the daily work of the Banking practice has shown that there are many irregularities or errors resulting from inadequate Internal Control System, these errors left traces on the Bank's activities that required the Bank of Algeria and Instructions issued Regulations that will boost confidence in the internal environment of the Bank.
