المسـؤوليـة عـن تلـويـث البيـئة البـحريـة بالنفـايـات في الجـزائـر

Abstract

يعتبر موضوع تلويث البيئة البحرية بالنفايات من المواضيع التي نالت اهتمام الدارسين والباحثين في الوقت الراهن، وذلك راجع إلى انعدام الوعي لدى الأفراد والجماعات بجسامة المخاطر الناجمة عن التلوث البيئي وعدم اهتمامهم بالحلول البديلة للتخلص من هذه النفايات، مما أثر سلبا على الوسط البيئي عموما وعلى البيئة البحرية خصوصا، وعرضت حياة الإنسان للخطر. لقد تعاملت الجزائر مع هذا الوضع من خلال عدة طرق نذكر منها إعداد وكالات متخصصة، اتخاذ الإجراءات اللازمة لمعالجة النفايات من خلال تطوير النظام القانوني المتعلق بمعاقبة المتسببين في إحداث الضرر البيئي، والمصادقة على العديد من الاتفاقيات والبرتوكولات الدولية الخاصة بحماية البيئة البحرية. كما بذل المشرع الجزائري جهود معتبرة من أجل تجسيد القواعد الدولية التي قبلتها الجزائر في مجال حماية البيئة البحرية من التلوث النفطي والتلوث الناجم عن السفن، بالنظر إلى المكانة التي يحتلها قطاع المحروقات وكذا قطاع النقل البحري في الجزائر، فتجسدت هذه الحماية بصدور أول قانون خاص بحماية البيئة وهو القانون رقم 83-03 المتعلق بحماية البيئة ثم تدرجت بعده القوانين وصولا إلى القانون رقم 03-10، حيث تضمنت هذه التشريعات أحكاما للتصدي إلى مخالفة الالتزامات المتعلقة بحماية البيئة البحرية والتي في غالب الأحيان تستوجب مساءلة المخالف عن طريق تطبيق نظام المسؤولية عن الأضرار البيئية، أي إقامة المسؤولية المدنية والمسؤولية الجنائية. This presentation focuses on the problem of litter in marine environment, as tons of garbage has continued to pile up in this area, because of human’s negligence, which indicate bad management of this waste, that caused big Environmental impact, and threat human life. Algerian government struggles to deal with this situation by many ways: Setting up dedicated agencies, Take all measures for modern waste treatment and developing of a legal system to punish the perpetrators of the damage in this environment. The Algerian legislature has made significant efforts to reflect international legal standards accepted by Algeria in the field of protection of the marine environment against oil pollution and pollution from ships. This protection from the first emission special law to protect the environment Law No. 83-03 on the protection of the environment and then gradually progressed beyond the laws and access to Law No. 03-10, was a result which has included the provisions of the circumstances of legislation to deal with the violation of obligations and duties related to the protection of the marine environment, which in most often requiring the offender accountability by the application of responsibility for environmental damage system.
