الالتـزام بالضمـان بيـن القـواعـد العامـة فـي التعـاقـد وقـانـون حمـايـة المستهـلـك

Abstract

إن نظرية ضمان العيوب الخفية تجد نطاقها العادي في الأحكام العامة في التعاقد المنصوص عليها في القانون المدني، كونها أداة مخولة قانونا للمشتري لإلزام البائع بتسليم مبيع مطابق ولا ينطوي على عيوب من شأنها حرمانه من الانتفاع بالمبيع على النحو المخصص له، غير انه إذا أردنا تطبيق هذه القواعد على المستهلك البسيط فإنها لا تكون كافية لتحقيق حمايته ومصالحه المادية خصوصا في ظل التطور الصناعي والتكنولوجي الذي يشهده العالم في عصرنا الراهن، لذلك كان لزاما على المشرع الجزائري استحداث قواعد قانونية خاصة تكفل حق المستهلك في الضمان وفقا لما يساير هذا التطور، وهو ما تجسده المواد 13 و14 من قانون حماية المستهلك وقمع الغش وكذا المرسوم التنفيذي 13-327 الذي يحدد شروط وكيفيات وضع ضمان السلع والخدمات حيز التنفيذThe theory of guaranteeing hidden defects finds it normal scope in the general provisions of the contract stipulated in the Civil Code, since it is legally authorized for the buyer as an instrument to oblige the seller to deliver a corresponding sale without defects that would deprive him/her of the use of the sale. However, if we want to apply these rules on the simple consumer, it cannot be sufficient to protect human rights in light of the industrial and technological development witnessed in nowadays world. That is why the Algerian legislator had to initiate special legal rules to guarantee the consumer's right to security in accordance with this development. This is reflected in Articles 13 and 14 of the Consumer Protection and Fraud Repression Act as well as in the Executive Decree 13-327 on executing the security of goods and services.
