Abstract

بعثت عمليات نقل وزراعة الأعضاء البشرية أملا بإنقاذ حياة المرضى، لذلك سعت التشريعات لتأطيرها بموجب جملة من الشروط القانونية، مُركّزة على شرط أهلية المتبرّع الذي قد يكون قاصرا. وبالتالي فإن التعبير عن رضائه ينتقل إلى وليه الشرعي الذي يتمتع بسلطة منح الإذن بإجراء عملية نقل عضو من المتبرع القاصر. وقد ثار جدل فقهي حول هذه المسألة، فانقسموا إلى مؤيد ومعارض، ليؤثر هذا الاختلاف حتى على موقف التشريعات لاحقا.The Transfer and transplant of human organs operations sent a great hope of saving the life of patients. which push many legislations to frame them with legal conditions, focusing on the capacity of the contributor who can be a minor. So, the expression of satisfaction moves to his legal tutor who has an authority to give permission to the process of the transfer of an organ from the minor donor. Over this issue, there was a jurisprudential debate, and they divided into supporters and opponents. This difference affects later even on the position of legislation.
