Abstract

ينصب موضوع البحث على التعريف ببعض الحقوق ذات الطبيعة الإجرائية على غرار الحق في الوصول للمعلومة والحق في المشاركة العامة والوصول للقضاء وسبل الإنصاف، والتي صيغت في شكل مبدأ مركب حظي بالاعتراف الواسع والمتكرر في وثائق القانون الدولي للبيئة كأسلوب حديث للتعبير عن وضمان تحقيق التمتع الفعلي به الحق الموضوعي للإنسان في بيئة سليمة وصحية ومنتجة، كما يمتد الموضوع للنظر ما يلعبه المبدأ من تعزيز التعاون الدولي في إطار الحوكمة البيئية عبر مساهمة مختلف الفواعل الحكومية وغير الحكومية في الرقابة والمسائلة لصناع القرارات المؤثر على البيئة.The subject is Focus on the definition of some of procedural rights along the lines of the right of access to information and the right to public participation and access to eradicate and remedies, which have been formulated in the form of the principle received wide and frequent recognition in the documents of international environmental law as a new Approach to express how to strengthen international cooperation and how to ensure the effective enjoyment of safe, healthy and productive environment substantive human right, and Also it extends to consider what principle play of effective environmental governance through the contribution of civil society in the oversight and accountability for decision makers affecting the environment
