مكانة رئيس الجمهورية في النظام السياسي الجزائري في ظل التعديل الدستوري لسنة 2008

Abstract

تعتبر التجارب الدستورية الجزائرية السابقة بمثابة مرآة عاكسة الصلاحيات الواسعة لرئيس الجمهورية، وذلك لأن كل تجربة تسعى لتعزيز معايير هذا التفوق، وتهدف هذه الدراسة إلى إبراز مدى مساهمة التعديل الدستوري لسنة 2008 في تكريس تفوق رئيس الجمهورية وتقدمه على باقي السلطات في الدولة. أبرزت الدراسة أثر التعديل الدستوري لسنة 2008 في تكريس هيمنة رئيس الجمهورية وأولويته على باقي السلطات العامة، من خلال الدور الذي يلعبه في العملية التشريعية التي تدخل في صميم عمل البرلمان، وتدخله في عمل هذه السلطات من خلال ما يقوم به من آليات تؤثر على مبدأ الفصل بين السلطات الذي يعد من الضمانات الأساسية لممارسة الديمقراطية، وانفراده بممارسة بعض الوظائف التي يفترض أن تشاركه فيها هذه السلطات، وتحكمه في الظروف غير العادية التي تخول له سلطات تقديرية لمواجهة هذه الظروف التي يتوقف فيها العمل بالدستور، مما يؤكد مكانته البارزة في النظام السياسي الجزائري. The Algerian constitutional experiences is considered as a mirror reflecting the superiority of the President, because each experiment seeks to enhance the standards of this superiority, so, the aim of this study is to highlight the contribution of the constitutional amendment in 2008 to devote outweigh the President and his lead over the rest of the authorities in the state. The study highlighted the impact of the constitutional amendment in 2008 to devote outweigh the President of the Republic and the priority over the rest of the public authorities, through its role in the legislative process which involve in the core of the work of Parliament, and his involvement in the work of these authorities through his mechanisms which affecting the principle of separation of authorities, which is one of the fundamental guarantees for the exercise of democracy, and he monopolize the practice of some of functions which are supposed shared with these authorities, and framed by extraordinary circumstances which entitle him discretionary powers to confront these circumstances which stops the action of constitution, which confirms his status prominent in the Algerian political system.
