الحرية الدينية لغير المسلمين في القفه الاسلامي و التشريع الجزائري

Abstract

يهدف البحث أساسا إلى تعريف المجتمع بحق غير المسلمين في الحرية الدينية كما هو مقرر لهم في الفقه الإسلامي والتشريع الجزائري ، وإلى التخفيف من حدة التوترات الاجتماعية ونشر ثقافة السلام والتعايش، والمساهمة في الخدمة العلمية للمدونة الفقهية الإسلامية والمنظومة القانونية الجزائرية، من خلال البحث في الإشكالية الرئيسية الآتية: "كيف نظم الفقه الإسلامي والتشريع الجزائري الحرية الدينية لغير المسلمين؟" في سياق الإجابة عن الإشكالية، تم البحث في التأصيل لحق غير المسلمين في الحرية الدينية من جانبين رئيسيين، باعتبارها معتقدا، واعتبارها ممارسة، كما تناول نظام الممارسة الدينية لغير المسلمين من حيث الضوابط أو القيود الواردة عليها، ومن حيث مظاهر الحماية المقررة لها، مستعينا في الوصول إلى النتائج المتوخاة بالمناهج المناسبة، كالمنهج المقارن، والمنهج الاستقرائي، والتحليلي، والتاريخي، وغيرها، حسب مقتضيات البحث. توج البحث بالتأكيد على ضمان الفقه الإسلامي والتشريع الجزائري لحق غير المسلمين في الحرية الدينية بكل أبعاده ومضامينه، وعلى عدم وجود قيود زائدة عن الحاجة مفروضة عن الممارسة الدينية لغير المسلمين، وعلى وجود ضمانات وآليات كافية في الجملة لحماية الحرية الدينية لغير المسلمين من الاعتداء عليها، بعكس ما تذهب إليه بعض الانتقادات غير الموضوعية، وعلى وجود تناغم وانسجام تام بين الفقه الإسلامي والتشريع الجزائري حول الموضوع. انتهى البحث بالتأكيد على مجموعة من الاقتراحات، تتعلق أساسا بإضافة مواد جديدة وإثراء مواد أخرى على مستوى المنظومة القانونية الجزائرية، المؤطرة للحرية الدينية لغير المسلمين من جهة، وتعميق البحث في مجموعة من الجوانب المتعلقة بالموضوع على مستوى الفقه الإسلامي من جهة أخرى. The research primarily aims to acquaint the society with the rights of non-Muslims to religious freedom as stipulated in the Islamic jurisprudence and the Algerian legislation. It seeks to alleviate social tensions, promote a culture of peace and coexistence, and contribute to the scientific service of Islamic jurisprudence and the Algerian legal system by investigating the following main problem: "How did Islamic jurisprudence and Algerian legislation regulate religious freedom for non-Muslims?" In addressing this problem, the research delved into the foundation of the right of non-Muslims to religious freedom from two main perspectives: as a belief and as a practice. It also examined the system of religious practice for non-Muslims in terms of its constraints or restrictions and the protective aspects provided for it. The research employed appropriate approaches; comparative, inductive, analytical, historical and others, based on the requirements of the study. The research concluded by affirming the guarantee of Islamic jurisprudence and Algerian legislation for the right of non-Muslims to religious freedom in all its dimensions and contents, the absence of unnecessary restrictions imposed on the religious practice of non-Muslims, as well as the existence of sufficient guarantees and mechanisms to protect the religious freedom of non-Muslims from infringement. This contradicts some unfounded criticisms. The research highlighted also a complete harmony between the Islamic jurisprudence and the Algerian legislation on this matter. Finally, the research put forward several suggestions, primarily related to adding new articles within the Algerian legal system and enriching existing ones which govern religious freedom for non-Muslims, on one hand, and delving into various aspects related to the research topic within the context of Islamic jurisprudence on the hand.
