Abstract

حقوق الإنسان والبيئة أصبحت من أكثر المواضيع التي تلقى اهتماما واسعا من طرف الباحثين في الشأن القانوني والسياسي وغيرهما من مجالات البحث العلمي، وذلك راجع للأهمية التي تحظى بها من طرف الفاعلين الرسميين وغير الرسميين، وعبر مختلف المستويات: الوطنية، الدولية والعالمية. ومع تزايد حجم ونوع التحديات البيئية زاد معها الحديث عن وجود علاقة بين حقوق الإنسان والبيئة، ذلك أن هذه التحديات البيئية لم تعد فقط ظواهر طبيعية، بل أصبح لها آثار وخيمة على الكثير من أنواع الحقوق التي كفلتها الكثير من المعاهدات والاتفاقيات الدولية. هذا الارتباط وجد فيه المدافعون عن البيئة فرصة سانحة لحماية أفضل وأكثر جدية للبيئة من أجل التقليل من حجم الانتهاكات التي تطالها، والتي يعتبر الإنسان هو المتسبب الرئيس فيها. This is due to their importance to both official and unofficial actors at various levels: national, international, and global. As the number and type of environmental challenges have increased, so has the discussion about the relationship between human rights and the environment. These environmental challenges are no longer just natural phenomena; they now have serious implications for many of the rights guaranteed by numerous international treaties and agreements. Environmental defenders have found in this relationship an opportunity for better and more serious environmental protection to reduce the extent of environmental violations, which humans are primarily responsible for Talking about human rights is not easy.
